Uploading or transferring any malicious software, viruses, or other harmful code; e. Impersonating any person or entity or falsely stating or misrepresenting your affiliation with any person or entity; f. Collecting or harvesting any personally identifiable information from other users of the App; g. Engaging in any activity that may impose an unreasonable or disproportionately large load on the infrastructure of the App. Intellectual Property:
2.1 Ownership: The App and all intellectual property rights associated with it, including but not limited to copyrights, trademarks, and trade secrets, are owned by us or our licensors. You acknowledge that the App is protected by applicable intellectual property laws and treaties.
2.2 Restrictions: You agree not to copy, modify, distribute, sell, or lease any part of the App, nor attempt to reverse engineer, decompile, or disassemble the App, unless expressly permitted by applicable law.
Disclaimer of Warranties:
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. USE OF THE APP IS AT YOUR OWN RISK.
Limitation of Liability:
IN NO EVENT SHALL WE, OUR DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR BUSINESS INTERRUPTION, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Indemnification:
You agree to defend, indemnify, and hold us harmless from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees and costs, arising out of or in any way connected with your use of the App or violation of these Terms.
Modifications to the App and Terms:
We reserve the right to modify or discontinue the App, temporarily or permanently, with or without notice. We may also revise these Terms from time to time. The most current version of the Terms will be posted on the App. Your continued use of the App after any modifications to the Terms constitutes your acceptance of the revised terms.
